In an earlier entry, we detailed the racial discrimination claim filed by two Fedex drivers of Lebanese descent. The plaintiffs were awarded more than $60 million in total damages by the jury that heard the case, which was a record award at the time. However, a recent article reported that the award was reduced significantly.
Specifically, the total award was reduced to $12 million, and each plaintiff was awarded $750,000 in compensatory damages and $5,250,000 in punitive damages. That compares to the original jury award, which was worth $5 million in compensatory damages and $25 million in punitive damages for each plaintiff.
The reason for the reduction in the award, according to the judge, was that the jury was affected by “passion and prejudice.” Judges do have discretion in reviewing damages awarded by a jury, and this reduction is hardly the first of its kind.
