Fedex Truck Found in River

In what could prove to be somewhat of an answer to an interesting liability question, CBS 13 in California reports that a Fedex truck was recently found in the

Sacramento River.  Although the truck appears to have been stolen, it could bring an interesting legal question to light if anyone was injured and sues for compensation.

The driver of the truck is seen as an independent contractor, which is a classification that has been widely disputed by drivers all over the

United States.  However, technically, independent contractors are generally solely responsible for any damages incurred in furtherance of their work.

However, given the controversy of whether or not Fedex drivers are independent contractors or employees, there’s no telling how such a decision would come down from the judge and/or jury.  Certainly, the classification issue would be part of the deliberations.
