California Driver is Terminated – Is that Legal?

An interesting story appeared recently on the Web site of CBS 13 in Sacramento.  It told the story of a Fedex driver who was found to be an unregistered sex offender who was still driving a Fedex truck and managing his route.  Below are the details:

“FedEx tells CBS13 they’ve fired a driver who failed to register as a sex offender.

Fifty-four-year-old Don Thurman Johnson was operating for FedEx Ground in

South Sacramento. He was convicted of forcible rape in 1978.

It was just last week that he was captured and released by police for not registering as a sex offender, and despite his arrest, FedEx was still employing him until now.”

Fedex claimed that they only do background checks going back seven years, but since he is not an employee, is it legal to fire him for this?  Would Fedex be liable if this driver had committed a crime while delivering?  These are all questions that remain unanswered.  If you have been wrongfully classified as an independent contractor by Fedex, contact the Fedex overtime attorneys at Pulaski & Middleman today to schedule a full consultation.
